International Patent Filing Options

PCT Route — Patent Cooperation Treaty

The PCT system, administered by WIPO, allows you to file a single international application that preserves your right to seek patent protection in over 150 member countries. A PCT application does not itself result in an international patent — patents remain national rights — but it provides an international filing date, an International Search Report (ISR), and a Written Opinion on patentability, and delays national phase entry for up to 30 months from priority.

Paris Convention Route

Under the Paris Convention, if you have filed a patent application in India, you may file corresponding applications in any other Paris Convention member country within 12 months, claiming priority from the Indian filing date. This is the direct route when fewer countries are targeted, or when time is short.

The FER typically raises objections on novelty, inventive step, industrial applicability, and formal matters. Our responses are technically detailed, legally precise, and strategically argued.
